Peter Mavrick is a Miami employment lawyer who successfully defended an international Miami business and its corporate officers in a lawsuit seeking class action certification for allegedly wide-scale federal labor law violations. The plaintiffs sought class certification for hundreds of current and former employees claiming large amounts of allegedly owed overtime and other wages. Damages were potentially in the millions of dollars. Mr. Mavrick successfully defended the company. Mr. Mavrick persuaded a Miami-Dade Circuit Court Judge that there could be no valid class certification because the employees failed to state a sufficient legal basis for the motion and to send notices to potential class members. Thereafter, almost a year later, the attorneys representing the potential class members filed another motion for class certification after adding new grounds to support the motion. Mr. Mavrick successfully argued to another Miami-Dade Circuit Court Judge that the new motion also failed as a matter of law because the federal court precedent in Florida and the Eleventh Circuit Court of Appeals (governing Florida federal courts) did not allow the grounds asserted by the plaintiffs. The Court agreed and denied the motion seeking conditional class certification “with prejudice,” meaning that the plaintiffs could not re-file the motion on the same or other grounds in the future.

Mr. Mavrick has had significant successes in defending other Miami businesses in employment law cases where large groups of employees sue their former or current employers and seek back wages. In another case, Mr. Mavrick won a jury trial defense verdict in a case seeking large damages with claims of fraud, civil theft, and seeking to impose equitable trusts over millions of dollars of real property and bank account assets that rightfully belonged to Mr. Mavrick’s client. After a week-long jury trial, the jury returned a complete defense verdict in favor of Mr. Mavrick’s client.

In a recent case, Mr. Mavrick successfully represented a Miami corporation that was sued in federal court for misappropriation of trade secrets. Mr. Mavrick persuaded the federal court that the plaintiff corporation could not lawfully assert a trade secret claim because the plaintiff was an intended third-party beneficiary of a complex contract that transferred the alleged trade secret information and was subject to the laws and venue of a European nation. The federal court agreed and dismissed the plaintiff’s case with prejudice.
